Terms of use
These terms explain how FaxFair works and what you agree to when you use it. In short: your first fax is free, then you buy faxes through Apple, each fax you send uses one fax for any length up to 40 pages (the cover page is free and counts toward the 40), and a fax that fails costs nothing. A fax number for receiving is sold for 7 days, 30 days or 1 year and doesn't renew.
In these terms, "we" means the maker of FaxFair. By using the app, you agree to these terms and to our privacy policy. If you got FaxFair from the App Store, Apple's standard license agreement for apps also applies to the app itself; these terms cover our fax service.
1. What FaxFair does
FaxFair for iPhone lets you scan or pick pages and send them as a fax to fax numbers in the United States (including Puerto Rico, Guam, the U.S. Virgin Islands, American Samoa and the Northern Mariana Islands) and Canada only. You can also buy a US fax number to receive faxes (section 3). On faxfair.com you can send a fax from your browser without the app, paid by card (section 5), and buy a fax number whose faxes we email to you (section 3). Some numbers can't be faxed, such as premium-rate numbers (900 and 976) and service numbers (such as 411 and 911). To stop abuse, we limit how many faxes one iPhone can send in a day and how many pages one fax can have, and the app tells you when you reach a limit.
2. Faxes and prices
- You buy faxes in the app, in packs. Apple processes the payment, and the app shows the price before you buy.
- Your first fax is free, any length up to 40 pages including the cover page, once per iPhone. If that fax fails, the free first fax stays available.
- Each fax you send uses one fax from your balance, for any length up to 40 pages including the cover page. The cover page costs nothing extra.
- When you send a fax, one fax from your balance is held for it. It's used only when the fax is delivered. If the fax fails, including one that stops partway, the fax held for it goes back to your balance.
- Faxes you buy don't expire.
- Faxes you buy can only be used to send faxes in FaxFair. They have no cash value and can't be sold or given to someone else.
- Faxes you buy are kept for the iPhone you bought them on, and they stay if you delete and reinstall the app. If you move to a new iPhone, contact support before you erase the old one and we'll move them.
- There's no subscription. You're only charged when you buy faxes or a fax number.
3. Fax numbers for receiving
- You can buy a US fax number in the app for 7 days, 30 days or 1 year. Apple processes the payment, and the app shows the price before you buy.
- We may stop selling new numbers for a time. The app says when.
- You choose your number from a live list of free US numbers, which you can search by area code or city, or you take any number.
- Your days start when you buy the number. If setting it up takes more than a few minutes, we add that time back. If we can't set up a number, the app tells you and gives our support address.
- The number doesn't renew. Buying again before the number is released adds the days you buy to the same number.
- The app reminds you before the number ends: 3 days before, or 1 day before for a 7-day number.
- When your days end, we keep the number for 3 more days. Faxes sent to it in that time arrive but stay locked until you buy more days.
- After those 3 days, we release the number and delete everything received on it. We never give a released number to another of our customers.
- The number is for receiving faxes in FaxFair. You can't transfer it to another carrier or service, or keep it after it's released.
- The number stays with the iPhone you bought it on, including after you reinstall the app. Restore a number, in the app, moves it to a new install or a new iPhone signed in to the same Apple Account.
- Received faxes don't use any of your faxes.
- We can't promise that every fax sent to your number arrives. The sender's machine, the phone line or a carrier can fail. Don't rely on the number for emergencies.
- Refunds for a fax number go through Apple, like other purchases (section 5). A refunded number keeps working until it expires.
Fax numbers bought on faxfair.com
- You can also buy a US fax number on faxfair.com for 7 days, 30 days or 1 year, without the app. You pay by card on Stripe's checkout page, at the price shown before you pay.
- Stripe holds the amount on your card, and we charge the card once your number is set up. If we can't set up the number, we cancel the payment and you aren't charged, although some banks show the hold as pending for a few days.
- We email each fax sent to your number to the address you give us, as a PDF, and list it on a private inbox page. Anyone with the link to that page can open your faxes, so keep it private. You can get a new link any time on the inbox page, and the old one stops working at once.
- You can change the email on the inbox page. We send the new address a new link, the old link stops working, and we tell the old address that the email was changed.
- The number doesn't renew. To keep it longer, add days on your inbox page before it's released. We add them to the same number, counting from its end date, or from the day you pay if it has already ended. We email you before the number ends.
- When your days end, we keep the number for 3 more days. Faxes sent to it in that time are held until you add days. After those 3 days, we release the number and delete everything received on it. We never give a released number to another of our customers.
- The faxes we email you are yours to keep. Deleting a fax on the inbox page deletes our copy, not your email.
- Don't use the number for anything illegal, such as fraud or pretending to be someone else. The rules in section 7 apply to it too.
- As with numbers bought in the app, you can't transfer the number to another carrier or keep it after it's released, and we can't promise that every fax sent to it arrives.
- If something goes wrong with a number you bought on the website, email [email protected] with the number.
4. Delivered and failed faxes
- Waiting: if all our fax lines are busy, your fax waits its turn with one fax from your balance held for it, and the app shows your place in line.
- Failed: if your fax isn't delivered (for example, the line was busy, nothing answered, the number isn't a fax line, the fax was canceled, or it wasn't delivered within 2 hours), the fax held for it goes back to your balance automatically and the app tells you why.
- Delivered: means the fax machine or fax service at the number you entered accepted the pages, as reported by our fax carrier. We can't confirm who picks them up or reads them.
- A fax to the wrong number that is answered by a fax machine counts as delivered. Please check the number before you send.
- How long a fax takes depends on the number of pages and the line at the other end. We don't promise delivery times.
5. Payments and refunds
Purchases in the FaxFair app are made through Apple. Refunds for App Store purchases are decided by Apple, under Apple's rules. To ask Apple for a refund, go to reportaproblem.apple.com. If you have a problem with a fax, email us first at [email protected].
Faxes sent from the website
You pay for a fax sent from faxfair.com by card, Apple Pay or Google Pay on Stripe's checkout page, at the price shown before you pay. Stripe places a hold for that amount on your card, and we charge the card only after the fax is delivered. If the fax fails, or we can't send it, we cancel the payment and you aren't charged, although some banks show the hold as pending for a few days.
A delivered fax isn't refunded automatically. If a delivered fax didn't come through properly, email [email protected] within 30 days with the link to its status page. If the problem was on our side, we refund the fax to your card.
6. Your documents
- Your documents stay yours. You let us store them and pass them to our fax carrier only to send your fax.
- We delete your document from our servers once the fax is delivered or fails. The app keeps its own copy on your iPhone while the fax is in Recent faxes.
- We delete our copy of a fax you receive when you delete it, 7 days after it arrives, or when the number is released, whichever comes first. The app keeps its own copy of faxes you opened. For a number bought on this website, we email each fax to you through Resend, which keeps a copy of each email, with the fax, for 30 days.
- You must have the right to send what you fax.
7. What you agree not to do
- Don't send fax advertising that the recipient didn't ask for. US law restricts unsolicited fax advertisements.
- Don't send anything unlawful, or anything threatening, harassing or fraudulent.
- Don't try to break, overload or get around how the app or our servers work, including the one free first fax per iPhone.
If you break these rules, we may stop your access to FaxFair.
8. Collectible stamps
Each delivered fax adds a stamp, chosen at random, to your album, and the app shows the odds before you buy faxes. Stamps are cosmetic: they have no value, don't change the service, and can't be bought, sold or traded.
9. Limits of our service
- Fax lines and the carriers that run them can fail, so we can't promise that a fax will be delivered, or delivered by a certain time, or that every fax sent to your number will reach you. What we do promise is what the app reports: a delivered fax was accepted at the number you entered, and a fax that fails costs nothing.
- FaxFair is provided as it is. To the extent the law allows, we make no other promises about it, and we aren't responsible for losses caused by a fax that was late or not delivered, such as a missed deadline.
- To the extent the law allows, our total responsibility for any claim is limited to what you paid for FaxFair faxes and fax numbers in the 12 months before the claim.
- Some places don't allow these limits, so they may not apply to you.
10. Changes
We may update these terms. We'll post the new version here and change the date at the top. If you keep using FaxFair after a change, the new terms apply.
